Agreement

These Terms of Use (“Terms”) govern your use of the iOS application Thrum – Tactile Fidget (the “App,” also referred to as “Thrum”) provided by Josef Dave Reyes Llorente (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms, Apple’s Licensed Application End User License Agreement (or any custom EULA presented in the App Store), and the App’s Privacy Policy and Content Rights notice.

If you do not agree, do not use the App.

The App

Thrum provides an on-device tactile fidget surface. It uses touch gestures and Apple’s Core Haptics framework to produce transient pulses and continuous feedback, with optional ripples and trails. Settings may include intensity, sharpness, dynamic response, visual feedback, and trail duration. The App may also be opened through Apple system features such as Shortcuts, Back Tap, or Control Center when you configure them.

Thrum is a recreational and sensory experience, not a medical device, health treatment, diagnostic tool, or substitute for professional medical advice or care. Results and perceived sensations vary by device, hardware support, system conditions, and user.

Eligibility and Accounts

You must be able to form a binding agreement under applicable law and comply with App Store age and account requirements. The App does not create a separate developer account; access is through your Apple ID and device as managed by Apple.

Device Compatibility and Safe Use

Haptic feedback requires a compatible iPhone. Unsupported devices may provide visual feedback only. Haptics may be unavailable or interrupted due to device capabilities, system state, power conditions, or other factors.

Use Thrum in a way that is comfortable for you. Stop using the App if you experience discomfort, pain, numbness, irritation, dizziness, distress, or any other adverse effect. Do not use the App when doing so would distract you from driving, walking in hazardous surroundings, operating equipment, or another activity requiring attention. Seek qualified professional advice for medical or accessibility concerns.

System Volume and Quick Access

While Thrum is active, changes to system output volume may also adjust the App’s saved intensity. Audio volume continues to change, and button presses at the system’s volume limits may not be detected by the App. Use the in-app intensity slider when needed.

Shortcuts, Back Tap, Control Center, VoiceOver, and other system features are provided and controlled by Apple. Their availability and behavior may vary by device and iOS version. You are responsible for configuring and using them appropriately.

Acceptable Use

You agree not to:

• Use the App for unlawful purposes or in violation of others’ rights
• Interfere with or disrupt the App’s normal operation
• Use the App in a way that creates a safety risk or materially distracts you during another activity
• Misrepresent the App as a medical treatment, diagnostic tool, or guaranteed therapeutic service
• Copy, reverse engineer, or redistribute the App except as allowed by law or Apple’s terms

Purchases

Thrum does not currently offer In-App Purchases. If paid functionality is introduced in the future, its pricing, billing, taxes, refunds, and restores will be governed by the terms presented at that time and Apple’s App Store policies.

Intellectual Property

The App and related materials are protected by intellectual property laws. Ownership and usage limits are described in the Content Rights notice. These Terms do not transfer ownership of the App to you.

Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that haptics will feel the same on every device, remain continuously available, produce a particular calming or sensory result, or meet any medical, therapeutic, or accessibility need.

Limitation of Liability

To the maximum extent permitted by law, Josef Dave Reyes Llorente will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from or related to your use of the App, even if advised of the possibility of such damages.

To the maximum extent permitted by law, total liability for claims relating to the App will not exceed the amount you paid for the App during the twelve (12) months before the claim, or zero if you obtained and used the App without charge.

Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.

Apple Relationship

These Terms are between you and Josef Dave Reyes Llorente, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any) as required by Apple’s policies; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you regarding your use of the App.

Changes

We may update these Terms by posting a revised version on this page and updating the effective date. Continued use of the App after changes become effective constitutes acceptance where permitted by law.
